Terms of Design

Copyright & Credits

Any images and HTML/CSS coding used in a blog design, website design, and/or general graphic design are Copyright protected by The Frilly Coconut.  All clients must maintain credits in their sidebar and footer that link back to The Frilly Coconut and any other elements and works used in the design. The Frilly Coconut requires the design to be maintained as it was installed. If any alterations are made to the design originally produced by The Frilly Coconut, all elements designed by The Frilly Coconut and all HTML/CSS code edited by The Frilly Coconut must be removed immediately by resetting the blog to a basic Blogger or WordPress template. Copying or editing any of the HTML/CSS code or graphics designed and/or edited by The Frilly Coconut will not be tolerated under any circumstances.

Should a user remove HTML/CSS coding and/or graphic design installed by The Frilly Coconut, users may not use or activate any theme installed by The Frilly Coconut.  Themes used in designs produced by The Frilly Coconut are purchased under a Developer’s License and only permit use by The Frilly Coconut. 

Payment & Fees

All design services require either a 50% or 100% deposit before the project is placed in the design queue. Because of the nature of the work and the time invested prior to and after beginning design work, refunds will not be given at any time regardless of the circumstances. Final design products will not be released to the client before final payment is received by The Frilly Coconut. Once final approval has been given, The Frilly Coconut reserves the right to charge additional hourly fees for any edits requested. Payments are accepted via Paypal ONLY unless prior arrangements are made with and approved by The Frilly Coconut.

Quotes & Timeline

Project quotes provided by The Frilly Coconut are only valid for 14 days.  All projects are quoted based on the New Project Questionnaire that is submitted for each project and only include the work specified in the questionnaire.  The Frilly Coconut  reserves the right to charge additional fees for any requests made in addition to what was originally provided by the client.

Client has 24-48 hours to respond to quote and projected start time, or they forfeit their reserved spot in the queue.

Design Queue & Communication

Before being placed in the queue, all submitted projects undergo review to determine whether or not they are a good fit for The Frilly Coconut.  The Frilly Coconut will not be held responsible for accepting all projects submitted in order to keep the design queue manageable.  Wait time in the queue is not guaranteed due to varying number of services being requested per project. The Frilly Coconut will not be held responsible for completing projects by a specified date unless a written guarantee is given by The Frilly Coconut.

A client’s failure to keep an open line of communication with The Frilly Coconut during the active design process within a reasonable amount of time may result in your project being rescheduled or removed from the queue without notification in order to prevent delays with other projects.

Privacy Policy

Any login or confidential information shared with The Frilly Coconut for any contracted services will be used only for installation of the design into a sample blog and/or final installation unless other permissions are obtained by The Frilly Coconut from the client. After design services are completed, login information is disposed of completely and appropriately.  If you wish, you are at liberty to provide The Frilly Coconut with temporary passwords until your final design has been installed.

Permission

Any designs produced by The Frilly Coconut may be selected for promotional use on any web or print marketing.

Liability

The Frilly Coconut will not be responsible for any lost images or design elements for failure to maintain any third-party accounts or plugins necessary for the upkeep of your blog or website. The Frilly Coconut will not be held responsible for any lost images or links to images from a previous design upon the installation of the design to your blog or website.  The Frilly Coconut is not responsible for website maintenance or anything not agreed to under contract and in writing.

To insure that your design is appearing correctly and as it was intended to, please make sure that you are using the most up-to-date form of your web browser.

By contacting me for any services you are agreeing to the Terms of Design as stated above.  Intentional or unintentional infraction of the Terms of Design will not be tolerated under any circumstances.
